This privacy policy governs your use of the software application Mappd (“Application”) for mobile devices that was created by Breton Goers. The Application is a simple mobile application that uses GPS location features to locate a user, and perform mathematical calculations in order to determine the total distance of mapped routes drawn by the user. Additionally, the user can share these mapped routes to social networks. Your privacy is very important to us. Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. The following outlines our privacy policy.
What information does the Application obtain and how is it used?
User Provided Information
The Application obtains no personally identifiable User information, unless the User opts in to an account using a social network such as Facebook. General use of the Application requires no personal information be provided, but the feature set is limited to on-device saving and sharing capabilities provided by Apple (including email, text, photo gallery, and printing).
Automatically Collected Information
The Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device's unique device ID, your mobile operating system, and information about the way you use the Application. Personally identifiable data is only collected from the User in the case that he or she opts in to an account using social login. Location data is collected, but location services are not required to use the Application. User location data is not stored by the Application or external services. Location waypoints of drawn routes are stored only when the User explicitly saves a route to the cloud.
Does the Application collect precise real time location information of the device?
This Application collects precise information about the location of your mobile device for the primary purpose of User convenience in interacting with the Application. User location information is not transmitted to or stored on external services, nor on the device itself. Location waypoints of drawn routes are stored only when the User explicitly saves a route to the cloud.
Do third parties see and/or have access to information obtained by the Application?
Only aggregated, anonymized data is periodically transmitted to external services to help us improve the Application and our service (analytics). We will share your information with third parties only in the ways that are described in this privacy statement.
We may disclose Automatically Collected Information:

as required by law, such as to comply with a subpoena, or similar legal process;

when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

What are my opt-out rights?
You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. Social sharing is an opt-in process, and the User has full control over shared content. The Application does not collect any personal data, unless willingly given permission to do so.
Data Retention Policy, Managing Your Information
The Application does not require User Provided data to function, nor does it store any data about the User collected through location services. Social sharing is accomplished through third-party software integration. The User has full control over their personal social network accounts, and should refer to those respective privacy policies. The Application only stores mapped routes when explicitly told to, and these are only linked to the User through their social network's unique user identifier.
Children
We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at bmgapps.ios@gmail.com. We will delete such information from our files within a reasonable time.
Security
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
Changes
This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. You must not use this mobile application in any way that causes, or may cause, damage to the mobile application or impairment of the availability or accessibility of the mobile application; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

Restricted access
Breton Goers reserves the right to restrict access to areas of this mobile application, or indeed this entire mobile application, at Breton Goers’ discretion.
User content
In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you explicitly submit to this mobile application, for whatever purpose.
You grant to Breton Goers a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to Breton Goers the right to sub-license these rights, and the right to bring an action for infringement of these rights.
Your user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or Breton Goers or a third party (in each case under any applicable law).
You must not submit any user content to the mobile application that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.
Breton Goers reserves the right to edit or remove any material submitted to this mobile application, or stored on Breton Goers’ servers, or hosted or published upon this mobile application.
Notwithstanding Breton Goers’ rights under these terms and conditions in relation to user content, Breton Goers does not undertake to monitor the submission of such content to, or the publication of such content on, this mobile application.
No warranties
This mobile application is provided “as is” without any representations or warranties, express or implied. Breton Goers makes no representations or warranties in relation to this mobile application or the information and materials provided on this mobile application.
Without prejudice to the generality of the foregoing paragraph, Breton Goers does not warrant that:

this mobile application will be constantly available, or available at all; or

the information on this mobile application is complete, true, accurate or non-misleading.

Limitations of liability
Breton Goers will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this mobile application:

Nothing in this mobile application disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this mobile application disclaimer will exclude or limit Breton Goers’ liability in respect of any:

Other parties

Indemnity

Breaches of these terms and conditions
Without prejudice to Breton Goers’ other rights under these terms and conditions, if you breach these terms and conditions in any way, Breton Goers may take such action as Breton Goers deems appropriate to deal with the breach, including suspending your access to the mobile application, prohibiting you from accessing the mobile application, and/or bringing court proceedings against you.
Variation
Breton Goers may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this mobile application from the date of the publication of the revised terms and conditions on this mobile application. Please check this page regularly to ensure you are familiar with the current version.
Assignment
Breton Goers may transfer, sub-contract or otherwise deal with Breton Goers’ rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.
You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.
Severability
If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
Entire agreement
These terms and conditions, together with the privacy policy, constitute the entire agreement between you and Breton Goers in relation to your use of this mobile application, and supersede all previous agreements in respect of your use of this mobile application.
Law and jurisdiction
These terms and conditions will be governed by and construed in accordance with United States law, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of the United States of America.
